SETTING UP A GUARDIANSHIP, POA OR POOLED TRUST
Seeking guardianship of a person should not be taken lightly and is utilized in situations where a person is being physically or financially exploited or do not have advanced directives in place and is deemed unable to make decisions for themselves.
Ideally we hope that our loved ones prepare for the future; that if something were to happen to them we would be able to do the very best for their care. Unfortunately, things don’t always work out that way. In situations where an individual hasn’t prepared and they become incapacitated, a guardian may be appropriate. Relatives are usually appointed as guardian but sometimes there is not an appropriate or willing relative or friend to take on this enormous responsibility. In these cases a corporate guardian is a viable option.
HOW WOULD A CORPORATE GUARDIANSHIP BENEFIT ME?
Managing the needs of an incapacitated person is no easy task. If proper housing needs to be secured, it is the responsibility of the guardian. If medical needs have to be addressed, it is the responsibility of the guardian. The guardian is also to manage the client’s financial and insurance needs, including applying for Medicare or Medicaid or Social Security, and is even responsible for making end-of-life decisions.
